Partner Visa Application Made Offshore (Subclass 309 and 100)

The applicant must be married or in a de facto relationship for at least 12 months with:

  • an Australian citizen
  • ​an Australianpermanent resident
  • ​an eligible New Zealand citizen


The Partner Visa can also be granted to same sex couples.

The application:

  • has to be lodged outside Australia and
  • you must be outside Australia when it is granted


To be eligible for a permanent partner visa subclass 100, applicant must obtain the Subclass 309 temporary visa first. The applicant can apply both permanent and temporary at the same time and pay only one fee. The applicant will be assessed for permanent partner visa after two years given additional documents will be required. If you have been in a long term relationship before you lodge your application, the permanent Partner (Migrant) visa (subclass 100) may be granted immediately after the temporary Partner (Provisional) visa (subclass 309).​

Family visas

Partner, Spouse and Parent visas are included under this visa and applicants can apply either in Australia or outside of Australia. 


Prospective Marriage Visa (Subclass300)

This Subclass 300 Prospective Marriage visa is a temporary visa granted for 9 months to get married which allows you to come to Australia to marry your prospective spouse.

The application:

- has to be lodged outside Australia and
- you must be outside Australia when it is granted. 
​- can not be extended. 

The visa will allow you to:

- travel in and out of Australia as many times as you wish for up to nine months
- work in Australia
- study in Australia at your own expense and
- apply for a Partner visa (820/801) in Australia

Your sponsoring spouse must be an Australian citizen, permanent resident or eligible New Zealand citizen.
Note that your partner may not be able to sponsor you if:
- they sponsored another person or
- had been sponsored within 5 years or
- if they have sponsored 2 people previously. 


This visa does not apply to same sex couples.The applicant and any dependant members must satisfy health and character requirements.

Partner Visa Application Lodged Onshore – Subclass 820 and 801

The applicant must be married or in a de facto relationship for at least 12 months with:

  • an Australian citizen
  • ​an Australianpermanent resident
  • ​an eligible New Zealand citizen


The Partner Visa can also be granted to same sex couples.

The application has to:

  • be made in Australia and
  • you must be within Australia when the visa is granted.


The temporary Partner Visa (subclass 820) will allow you to:

  • remain in Australia until a decision is made about your permanent Partner visa;
  • work in Australia;
  • study in Australia at your own expense; and
  • enrol in Medicare


Your dependent children can be included in your application and must be in Australia when they apply. 

You can apply both temporary and permanent visa at the same time. The applicant will be assessed for permanent partner visa after two years given additional documents will be required.


The Permanent Partner visa (subclass 801) will allow you to:

  • stay in Australia indefinitely;
  • work and study in Australia;
  • apply for Australian citizenship if you are eligible;
  • sponsor eligible relatives for permanent residence;


The applicant and any dependant members must satisfy health and character requirements.

Your partner must sponsor you. Your partner may not be able to sponsor you if:


  • they sponsored another person or 
  • had been sponsored within 5 years or 
  • if they have sponsored 2 people previously.
